Our attorneys have represented 1,000's of teachers, administrators, bus drivers, food service workers, paraprofessionals, and other public school employees in defense of their employment, including contract disputes and tenure due process hearings, state and federal court trials and appeals involving terminations, nonrenewals, suspensions, demotions, employment discrimination, and 1st Amendment rights. B. Student Disciplinary Actions of Expulsion/Suspension
We represent students facing disciplinary actions in hearings before administrative hearing officers or tribunals, review by the local school board, and in appeals to the Georgia Board of Education, and the Superior Courts.
Professional Licensing & Liability
Our professional licensing and liability practice focuses on defending professionals in certificate/licensing disputes before state licensing boards that have filed disciplinary charges leading to suspension or revocation of the professional certificate/license. Kramer & Patel attorneys have handled hundreds of certificate/license defense cases for certificated educators, licensed paraprofessionals, other public school employees in cases brought by the Professional Standards Commission, litigated before the Office of State Administrative Hearings, and appealed to the Superior Court and Georgia Court of Appeals and Supreme Court. Kramer & Patel attorneys will also represent physicians, psychiatrists, psychologists, and professional counselors in defense of their professional licenses brought by the Georgia Composite State Board of Medical Examiners through administrative hearing and all appeals.
Whistleblower/Qui Tam Litigation
Our attorneys brought one of the first Georgia Whistleblower Act lawsuits against Kennesaw State University and the Regents University System of Georgia on behalf of a Higher Education faculty member. Partner Michael E. Kramer, Esq., was instrumental in drafting amended provisions to the Act passed by the Georgia General Assembly in 2004, providing for backpay and compensatory damages for state employees retaliated against for reporting violations of local, state, and federal law. Federal "Qui Tam" claims brought under the False Claims Act are designed to punish entities that defraud the federal government and also monetarily reward individuals who act as whistleblowers in disclosing and initiating legal action to prosecute the fraud.
